An attorney who has been involved in several cases alleging Barack Obama isn't qualified to be president because he is not a "natural born citizen" as required by the Constitution now is asking a California judge to investigate possible fraud against the court.

Orly Taitz, who has, among other cases, one pending at the 11th U.S. Circuit Court of Appeals on behalf of a member of the military wondering whether orders from Obama as commander-in-chief are valid, said the possibility of fraud is one of several concerns in the case.

"There is such a high probability of criminal acts of identity theft and Social Security fraud committed by the respondent that the undersigned requests this honorable court to use its inherent powers to order Sua Sponte an evidentiary hearing on this particular issue for possible criminal prosecution," she wrote in her latest arguments that also request the case be moved to Washington, D.C.

If anyone remains unclear about why it's such a dangerous conceit for the President to allow foreign terrorists to be charged as civilians and tried in US civilian courts, a report from today's London Telegraph spells it out.

Apparently, the 23-year-old Nigerian who tried to blow up a Northwest flight on Christmas day was "singing like a canary" until he was provided with a lawyer, in accordance with Miranda requirements that attach to civilian trials in the United States. He was about to disclose information about other such plots being hatched by Al Qaeda in Yemen, using other young Muslim terrorists like himself.

Then the terrorist was provided with a lawyer. And he stopped talking.

During the summer of 2009, many of us watched helplessly the bailout of GM and Chrysler, the misuse of TARP funds, the sudden new ownership of the UAW to the tune of 60 percent of Chrysler and the sale of the remainder to Fiat, the Canadian government and the U.S. Government with nothing short of astonishment. Many of us could sense the fundamental wrong that was occurring, but the public was kept in the dark regarding the devil in the details – what was being done and who it was being done unto – until it was far too late to stop it.
Who engineered one of the most glaring abuses of power in the history of the United States? That would be both the administration and the team created by the White House that has crafted and supported the deal that sold Chrysler to Fiat and the UAW et al. The administration crafted and hired a team that gave the labor union UAW 60 percent ownership of a business its members were employed at, something unions have been vying for since they were first created in the 1800s (it has been labor’s historical stance that they should be the ones running the show, not the businesses owners). In a deal of highly questionable legality and zero ethics breaking standard business practices, the Union now does. That’s quite the payoff for union support, isn’t it? Talk about a quid pro quo. Then there is the several billion in taxpayer dollars that went to Fiat, an Italian company, to seal the deal. But pay no attention to the man behind the curtain…
Beyond lost billions and the blatant payback to the Union, there were a large number of victims in the actions taken following this unbelievable decision in New York. How could this happen, and specifically, who requested of Judge Gonzalez the Dealer Rejection Order? The short answer is: only one, Old Chrysler.

Senior House Democrats have largely abandoned hopes of including a government-run insurance option in the final compromise healthcare bill taking shape, according to several officials, and are pushing for other measures to rein in private insurers.

House Speaker Nancy Pelosi and other senior Democrats told President Barack Obama in recent meetings they want the legislation to strip the insurance industry of a long-standing exemption from federal antitrust laws, officials said. That provision is in the House-passed measure, but was omitted from the bill that the Senate passed on Christmas Eve.

They also want the final measure to include a House-passed proposal for a nationwide insurance exchange, to be regulated by the federal government, where consumers could shop for private coverage. The Senate bill calls for a state-based system of exchanges.

But this survey out late Saturday from Public Policy Polling (D) (744 LVs, 1/7-9, MoE +/- 3.6%) is sure to have Democrats across the country in a more obvious panic.

The Wall Street Journal is reporting today that as Democrats scramble for ways to pay for their impossibly expensive health care overhaul plan, they are looking at new taxes. What a shocker.

House and Senate negotiators are considering applying for the first time the Medicare payroll tax to investment income as part of a compromise to pay for a health overhaul.

The extra Medicare tax would apply only to the wealthy and could allow congressional Democrats to reduce the sting of a tax on high-cost insurance plans, said Democratic aides and others briefed on the negotiations.

From winding down the war in Iraq to limiting lobbyists, Obama has made some progress. But the president has faced political reality and accepted - sometimes grudgingly - compromises that leave him exposed to criticism. Promises that have proven difficult include pledges not to raise taxes, to curb earmarks and to shut down the Guantanamo Bay detention facility in Cuba by the end of his first year.

"We are moving systematically to bring about change, but change is hard," Obama told a town hall crowd in California. "Change doesn't happen overnight."

Members of the ND88 travelled to South Bend in May to protest the university's honoring of Obama (whom pro-lifers have called "the most pro-abortion President in U.S. history") at its commencement. In many cases their "protest" took the form of walking onto campus and praying and/or carrying pro-life signs. For this "crime" they were handcuffed, arrested, and thrown in prison.

The Daily Caller, a new online publication launched by conservative Tucker Carlson, reported Friday that the GOP state senator has raked in most of that money through online donations, as his campaign sees a last-minute surge before the special election set for Tuesday.

Brown is up against Democrat Martha Coakley, the state attorney general thought to be the front-runner in the race for the seat formerly held by the late Sen. Ted Kennedy.

Lawyers are being positioned even over the weekend to file a legal action quickly in support of the GOP candidate in the Massachusetts special election to fill the U.S. Senate seat vacated by the death of Sen. Ted Kennedy should he succeed in defeating a hand-picked Democratic successor.

There is concern that since a victory by Republican Scott Brown over Attorney General Martha Coakley in the battle to replace Kennedy would threaten President Obama's health care plan in the U.S. Senate – Brown has promised to be a key vote against the plan – Democrats in power would delay certifying the election and getting him seated in the Senate.

That amount said they would definitely or probably vote for someone else, according to the Allstate/National Journal Heartland Monitor poll. The amount that would definitely vote against Obama totals 37 percent.

CrossTarget used the exact method – Interactive Voice Technology (IVR) – it used in a similar poll for PJM on Friday. The previous poll showed Brown ahead by approximately 15%.

A poll released earlier Sunday from the Merrimam River Group shows Brown up by an identical 9.6%.

Wow. WBZ reports heavy traffic at the polls for the special election in Massachusetts today. The secretary of state predicts 40 percent turnout:

In contrast to the light turnout for the party primaries last month, there are already signs of a heavy turnout.

A line of cars stretched for nearly a half-mile from the gymnasium at North Andover High School. Some drivers turned around in exasperation.

Massachsuetts Secretary of State William Galvin told WBZ he expects about 40-percent of voters to turn out for the special election.

Galvin said about 800,000 came out for the primaries and he believes that should double to 1.6 million based on the intense interest in this campaign.

Next to health care, the issue that has dominated the debate in the Massachusetts Senate race is terrorism. Scott Brown, the Republican running ahead in the race for Ted Kennedy's Senate seat today, has campaigned as an unabashed supporter of enhanced interrogation. Brown - who serves as a JAG lawyer in the Army National Guard - has argued that the Christmas Day bomber should be interrogated as an enemy combatant, not given the right to remain silent. And he has said of waterboarding, "I do not believe it is torture. America does not torture ... we used aggressive, enhanced interrogation techniques."

There is a lesson here for Republicans. If an outspoken supporter of waterboarding can run this strongly in the People's Republic of Massachusetts, imagine how the issue will play in the rest of America.

The fact is President Obama has placed our country in grave danger by dismantling the CIA's program to interrogate senior terrorist leaders like Khalid Sheikh Mohammed. By limiting all terrorist interrogations to the techniques in the Army Field Manual, Obama is actually requiring that captured terrorists receive better treatment in the interrogation room than common criminals being questioned at your local police precinct. Not only has he eliminated lawful interrogation techniques, under his administration the United States is no longer trying to capture the leaders of al Qaeda alive, and bring them in for interrogation so they can tell us their plans for future attacks.

The United States on Friday moved a step closer to prosecuting five men accused of plotting the September 11, 2001 attacks before a civilian court in New York.

In a statement, the Pentagon said it had withdrawn charges against the five men that had been filed before a military tribunal at Guantanamo Bay.

That clears the way for them to face fresh charges before a New York court, just steps from the site of the World Trade Center destroyed in the attacks.

It has, however, recently come to our attention that a paragraph in the 938-page Working Group II contribution to the underlying assessment refers to poorly substantiated estimates of rate of recession and date for the disappearance of Himalayan glaciers. In drafting the paragraph in question, the clear and well-established standards of evidence, required by the IPCC procedures, were not applied properly.

Susan Collins, the panel’s ranking Republican: “Were you consulted regarding the decision to file criminal charges against [suspect Umar Farouk] Abdulmutallab in civilian court?”

Leiter and Napolitano gave the same answer. “I was not.” Blair also said, “I was not consulted,” and asserted that the government “should have” brought in a special High-Value Interrogation Group (HIG) to conduct the questioning of the suspect—a comment that infuriated senior officials in the White House and revealed an apparent rift among national-security officials over the handling of the Christmas Day incident.

But some officials (who asked not to be identified because of the sensitivity of the issue) said those responses to the panel may have been misleading and glossed over the extent to which all the relevant national-security agencies, including top aides to Blair and Napolitano, were fully informed about the plans to charge the suspect in federal court hours before he was read his Miranda rights and stopped cooperating.

Luiz Gutierrez (D-Ill.) -- which would provide a “pathway to citizenship” for illegal aliens -- has a good shot at passage this year.

But Moulitsas said that “tea*******” and Republicans who “hate brown people” would try to push back against it.

“I think the votes want to be there in the Senate -- I think the House is fairly solid -- I think the votes want to be there,” he said of an immigration bill’s chances, “but you have this growing ‘tea******’ movement that is going to be pushing very hard from the other side.”

The freeze would take effect in October and limit the overall budget for agencies other than the military, veterans affairs, homeland security and certain international programs to $447 billion a year for the remainder of Obama's first term, senior administration officials said Monday, imposing sharp limits on his ability to begin initiatives in education, the environment and other areas of domestic policy.

Although the freeze would shave no more than $15 billion off next year's budget -- barely denting a deficit projected to exceed $1 trillion for the third year in a row -- White House officials said it could save significantly more during the next decade. They described the freeze as a critical component of a broader deficit-reduction campaign intended to restore confidence in Obama's ability to control the excesses of Washington and the most lavish aspirations of his own administration.

NEW YORK (AP) - New York Mayor Michael Bloomberg said Tuesday he has "no plans" to run for president and insisted that hiring Hillary Rodham Clinton's former media strategist is not a step toward a future White House bid.

But the billionaire Republican-turned-independent appeared to enjoy the speculation when asked about the political implications of Howard Wolfson joining his administration as an adviser.

Wolfson's broad political experience will likely renew national interest in Bloomberg, just as it did in the lead-up to the 2008 race, when it thrust him into the spotlight instead of letting him fade away as a second-term mayor.

Bloomberg smiled and told a reporter, "I can't believe you're even asking" about presidential plans, then went on to say he's thrilled to have someone like Wolfson leave a lucrative consulting business to join city government.

WASHINGTON – Reaching out to a skeptical gay community, President Barack Obama on Wednesday urged Congress to repeal the ban on gays and lesbians serving openly in the military, but neither made a commitment to suspend the practice in the interim nor issued a deadline.

Obama's reference to the so-called "don't ask, don't tell" practice took only 32 words of his State of the Union address, but drew criticism from Democratic allies and Republican opponents alike. It also underscored the challenge Obama faces, not just with Congress but also with the Pentagon, where some top officials have been strident in their support for the Clinton-era policy.

"This year, I will work with Congress and our military to finally repeal the law that denies gay Americans the right to serve the country they love because of who they are," Obama said in prepared remarks.

Tonight, Barack Obama said, “To close that credibility gap we must take action on both ends of Pennsylvania Avenue to end the outsized influence of lobbyists; to do our work openly; and to give our people the government they deserve.

“That’s what I came to Washington to do . That’s why – for the first time in history – my Administration posts our White House visitors online. And that’s why we’ve excluded lobbyists from policy-making jobs or seats on federal boards and commissions.”

Maybe this explains why his national security policies are so weak. He put William Lynn in the Pentagon as Deputy Defense Secretary. Mr. Lynn was a lobbyist for Defense Contractor Ratheon. I guess the Deputy Defense Secretary is not a policy-making job....more...

Sarah Palin's recent book success and her new high-profile role on Fox News are having a stunning impact on her political standing with a Newsmax-Zogby poll showing the former Alaska governor now leading the GOP field as the party's preferred candidate for president.

The exclusive Newsmax Media-Zogby poll released Thursday asked likely GOP voters: "If the Republican primary for president of the United States were held today... for whom would you vote?"

The poll gave voters a selection of top tier potential candidates as well as some dark horses, the list included Scott Brown, Jeb Bush, Newt Gingrich, Mike Huckabee, Sarah Palin, David Petraeus, Tim Pawlenty, and Mitt Romney.

So amazingly said Newsweek's Howard Fineman shortly after President Obama finished his State of the Union Address, but that wasn't the only absurd thing he told MSNBC's Keith Olbermann on Wednesday's "Countdown."

"In many, many ways, this is one of the most conservative speeches that a Democratic president has given since I think the middle of Bill Clinton's time," Fineman idiotically claimed.

I guess in all his excitement, Fineman forgot that Obama IS the first Democrat in the White House SINCE Clinton (video embedded below the fold with transcript, h/t Story Balloon):

President Barack Obama's plan to "freeze" a tiny portion of the federal budget hit Washington with a "thud" Jan. 26.

Conservatives argued that the spending freeze Obama would highlight in his State of the Union address Jan. 27 wasn't enough. Liberals, including New York Times columnist Paul Krugman called it "appalling on every level."

Krugman denounced the plan as "bad long-run fiscal policy." Of course, this is the same columnist who argued for a much larger stimulus package than the $787 billion one that was signed into law.

After Obama's State of the Union address the spending freeze seemed all but forgotten - and no wonder since the speech was full of proposals to spend, spend, spend.

The overnight ratings are in for Pres. Obama’s first State of the Union, and the broadcast networks combined for 30.2 million total viewers during the 9-10:30pm speech.

The winner for the night – surprisingly it was FOX, which surely benefited from its American Idol lead-in.

Shepard Smith anchored for FOX broadcast network, and he led the network competitors by a hefty margin. FOX averaged 9.74 million total viewers during the 9pm hour, compared to ABC with 7.64, NBC with 7.15 and CBS with 6.16.

Fox News regularly beats its cable news competitors for Pres. Obama speeches, but FOX doesn’t always even air the special events when it comes to Pres. Obama (although a State of the Union is different from a press conference).
